The IRS Is Taking Your Paycheck. Here Is What Actually Stops It.
An IRS wage levy stops when the reason for it is resolved, not when you call and object. The routes are an installment agreement, currently-not-collectible status, a hardship-based release under IRC section 6343, or a Collection Due Process hearing on Form 12153. A bank levy holds funds for only 21 days, so timing decides the outcome.
A wage levy on Form 668-W is continuous. It does not take one payment and stop, it keeps taking every cheque above the exempt amount until it is released or the balance is satisfied. That is why this is the one tax problem where a week of delay genuinely changes the result.
Levy Situations We Handle
Bring the notice and the most recent pay stub and we can usually tell you the same day what is possible.
Wage Levy Already Hitting Your Paycheck
Form 668-W served on your employer. Continuous until released, and visibly embarrassing at work, which is its own reason to move fast.
Bank Account Levy With Funds Frozen
Form 668-A starts a 21-day hold. Inside that window a release can still return the money; after it, recovery is far harder.
Final Notice of Intent to Levy Received
LT11 or Letter 1058. You have 30 days to request a Collection Due Process hearing, and that right does not come back.
Levy on a Business Bank Account
Often tied to unpaid payroll tax. It can stop a business from meeting its own payroll, which escalates the problem quickly.
Levy While You Cannot Afford Basics
Where the levy prevents you meeting necessary living expenses, IRC section 6343 provides for release on economic hardship grounds.
FTB Earnings Withholding Order
California runs its own garnishment process. Releasing the IRS levy does nothing to the state order.
How We Get a Levy Released
Levy work is sequencing. The release request has to be paired with a resolution the IRS can accept.
Same-Week Form 2848 Authorization
Signed authorization first, because until it is on file the IRS will not discuss your account with anyone but you.
Transcript Pull and Deadline Check
Establishing what is owed, which years, and critically whether the 30-day Collection Due Process window is still open.
Levy Release Request
Made directly to the assigned unit or revenue officer, paired with the alternative resolution that justifies lifting it.
Collection Due Process Hearing (Form 12153)
Filed inside the window where it is still available, which generally suspends levy action while Appeals considers the case.
Hardship and Exempt-Amount Review
Confirming the exempt amount was calculated correctly for your filing status and dependents, and pursuing hardship release where it applies.
Then the Underlying Balance
A release without a resolution invites the next levy. We deal with the balance so it does not simply happen again.
Levy timelines are short and fact-specific. Nothing here guarantees a release in your case.
